MINUTES

Members Present: Robert Lowell, Anthony Costello, Matt Kennedy and Ken Strom.

Members Absent: Michael Scott

Staff Present: Dan Hazen, Teresa McIntyre

Others: David Clarke, Janet Cyganski, David Cyganski, Don MacMaster, David Getman, Jeff Lizotte, Paul McManus, Mark Donahue, Gaye Robinson, Neil Harvey, and Rosemary Johnson.

The meeting began at 7:00 PM

NOTICE OF INTENT – Winterberry Hollow- M. Donahue reviewed all the changes made to the original plan.  A discussion ensued between the Commission, P. McManus, and M. Donahue and regarding DEP’s reluctance to issue a decision in writing.  There continued to be extensive discussion regarding the access road to Newell and details regarding the infiltration basins.

With no further questions for the Commission, the floor was opened to the public for questions or comments.

One abutter urged the Commission to apply the rule that was in place in March.  Several other abutters raised questions regarding the clarification of the Zone A definition and the mapping of the tributary locations, as well as the use of the 2008 maps.  These topics were discussed at length. As a result of this discussion, M. Kennedy requested that one of the conditions attached to the Order would be that the Conservation Commission would review the 2009 maps.

With no further comments or questions, K. Strom made a motion to close the hearing. R. Lowell seconded the motion.  All were in favor.  The applicant’s representative and the Commission agreed that a draft of the conditions will be presented at the next meeting when the Order of Conditions will be issued.

DISCUSSION – Wachusett Woods Subdivision – The applicant’s engineer questioned the Commission on the course of action required after the Order of Conditions expired in May of 2009.  The Commission responded that the applicant must refile and pay the new fees.

ALDEN WOODS SWALE – D. Hazen told the Commission that he has not had the opportunity to review the report from CB Blair Development Corporation.  Continued until next hearing.

CERTIFICATE OF COMPLIANCE – Lot 2 – The site was reviewed and shown to be in compliance.  A. Costello made a motion to issue a Certificate of Compliance.  R. Lowell seconded the motion. All were in favor.

CERTIFICATE OF COMPLIANCE – 373 Sycamore Dr. – Applicant has maintained the buffer and the area is in good order.  R. Lowell made a motion to issue a Certificate of Compliance.  K. Strom seconded the motion. All were in favor.

CERTIFICATE OF COMPLIANCE – Wagner Meadows – Lot 14 & 26 – K. Strom recused himself, which resulted in a lack of quorum.

CERTIFICATE OF COMPLIANCE – Surrey Lane Extension – The Commission was unable to vote, as the Department of Public Works has not finished the review of the detention ponds. Hearing is continued until next meeting.  

CERTIFICATE OF COMPLIANCE – 335 Sycamore Dr – D. Hazen explained to the Commission that the Fox Hill Subdivision holds the original Order of Conditions.  The applicant asked for a partial release for Lot 76R to finalize the sale of the home.  R. Lowell made a motion to issue a Certificate of Compliance. K. Strom seconded the motion. All were in favor.

APPROVAL OF MINUTES – A, Costello made a motion to approved the Minutes of October 7, 2009.  R. Lowell seconded the motion. All were in favor.

BRIEF DISCUSSION – Holden Reservoir #2 - D. Hazen informed the Commission that Camp Dresser McKee (CDM) is replacing two sluice gates at the Holden Reservoir #2.  After a short discussion, the Commission agreed that project complies with the regulations.


R. Lowell made a motion to adjourn.  K. Strom seconded the motion. All were in favor.

The meeting adjourned at 8:16 PM.

The next meeting is scheduled for December 2, 2009.
